1. About the Apps
The YutthaKalam Apps are operated by Yuththa Kalam Kalari Academy, Pondicherry, India ("Academy", "we", "us", or "our"). The Apps are a private academy management platform available exclusively to:
- Enrolled students of the Academy
- Parents or guardians of enrolled students
- Instructors employed or engaged by the Academy
- Authorised Academy administrators
Access is by invitation only. The Apps are not available to the general public.
2. Acceptance of Terms
By installing or using any of the Apps, you agree to these Terms and our Privacy Policy. If you do not agree, you must uninstall the App and discontinue use immediately.
For users under 18, a parent or guardian must review and accept these Terms on their behalf. By allowing a minor to use the App, the parent or guardian accepts these Terms.
3. Account and Access
Access to the Apps is granted through your registered mobile phone number and a one-time password (OTP) sent via WhatsApp. You are responsible for:
- Keeping your phone secure and not sharing your OTP with anyone
- All activity that occurs under your account
- Notifying the Academy immediately if you suspect unauthorised access to your account
- Keeping your contact information up to date
The Academy reserves the right to suspend or terminate access to any account at any time, with or without notice, if it believes the account is being misused or if the user's association with the Academy ends.
4. Role-Specific Responsibilities
- Use the App to track attendance, view practice schedules, submit videos, pay fees, and communicate with instructors and admin
- Upload only practice videos of yourself that are relevant to your Kalari training
- Maintain respectful conduct in all chat messages and feed posts
- Pay fees on time as notified through the App
- Not share account access with others
- Use the App solely to monitor your child's progress, fees, attendance, and communicate with the Academy
- Ensure your child uses the App in accordance with these Terms
- Maintain respectful communication with instructors and admin through the App
- Not attempt to access other students' data through the App
- Use the App to manage attendance, sessions, student reviews, and communicate with students and admin
- Provide timely, constructive feedback on student practice videos via text or voice message (recorded using your device microphone)
- Maintain professional conduct in all communications through the App
- Not share access credentials or student data with unauthorised parties
- Report any technical issues or concerns to the Academy admin promptly
- Use the App to manage academy operations including student enrolment, fees, salaries, scheduling, and reporting
- Handle all personal data accessed through the App in accordance with our Privacy Policy
- Not use administrative access for any purpose outside of legitimate Academy operations
- Ensure that account creation and access management follow Academy policies
5. Acceptable Use
You agree not to use the Apps to:
- Post, upload, or share content that is offensive, abusive, defamatory, obscene, or harassing
- Impersonate another person or misrepresent your identity or affiliation
- Upload content that infringes any third-party intellectual property rights
- Attempt to gain unauthorised access to other users' accounts or any part of our systems
- Reverse engineer, decompile, or tamper with the Apps
- Use the Apps for any commercial purpose other than Academy operations
- Distribute spam, malware, or any harmful content
- Violate any applicable law or regulation
Violation of these rules may result in immediate account suspension and, where appropriate, legal action.
6. Device Permissions
The Apps request the following device permissions to function correctly:
- Microphone — for recording voice feedback on practice videos (Instructors and Students)
- Storage / Media — for selecting and uploading practice videos and profile photos
- Notifications — for receiving class reminders, fee alerts, and academy announcements
You may deny any permission, but some features of the App will not work without it. Permissions can be managed at any time through your device settings.
7. Content You Upload
You retain ownership of any content you upload to the Apps (profile photos, practice videos, messages, and feed posts). By uploading content, you grant the Academy a non-exclusive, royalty-free licence to store, display, and use that content solely for the purposes of operating the Apps and providing academy services.
You warrant that any content you upload:
- Does not infringe any third-party copyright, trademark, or other rights
- Does not contain any person's personal information without their consent
- Is relevant to Kalari Adimurai training and academy activities
- Does not violate these Terms or any applicable law
The Academy reserves the right to remove any content at its discretion without notice.
8. Fees and Payments
Fee amounts, due dates, and payment instructions are set by the Academy and communicated through the Apps. Payments are processed through Razorpay, a third-party payment gateway. By making a payment through the App, you also agree to Razorpay's terms of service.
The Academy is not responsible for payment failures caused by your bank, payment method, or network issues. For payment disputes, contact us at contact@yuththakalam.com.
9. Intellectual Property
All content in the Apps — including the design, graphics, logos, text, and software — is the property of Yuththa Kalam Kalari Academy or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of the Apps without our prior written consent.
The name "Yuththa Kalam", "YK Aasan", "YK Admin", and associated logos are trademarks of the Academy.
10. Privacy
Your use of the Apps is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please read it carefully to understand how we collect, use, and protect your personal data.
11. Disclaimers
The Apps are provided "as is" without warranties of any kind, express or implied. The Academy does not warrant that the Apps will be available at all times, free from errors, or free from viruses or other harmful components.
Kalari Adimurai is a martial art that involves physical activity. The Apps are a management tool and do not provide training advice or medical guidance. Physical training is undertaken at your own risk under the direct supervision of qualified instructors.
12. Limitation of Liability
To the maximum extent permitted by law, the Academy shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Apps, including but not limited to loss of data, loss of income, or injury.
The Academy's total liability for any claim arising from these Terms or use of the Apps shall not exceed the fees paid by you to the Academy in the three months preceding the claim.
13. Termination
These Terms remain in effect for as long as you use the Apps. Your access will automatically terminate when your association with the Academy ends (e.g., upon leaving the academy, completion of enrolment, or end of employment as an instructor).
The Academy may terminate or suspend your access at any time for violation of these Terms or for any other reason at its sole discretion. Upon termination, you must stop using the Apps immediately.
14. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted at yuththakalam.com/termswith a revised "Last updated" date. Continued use of the Apps after changes are posted constitutes your acceptance of the updated Terms. For significant changes, we will notify you via push notification or in-app message.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Pondicherry, India.
